I don't know them well enough to ask why they do not counter-sue. (They may have, I don't know.) I also don't know and don't presume to know their feelings or thoughts about counter suing. Just this quote (above) got my attention. I have been talking with my dad about the Faire issues for a while now. Many, many, many years ago, he was the Cuyahoga County Assessor and still has many friends who still work for the county. He was speaking with a few friends this past week, and they all seem to be in agreement: Larry has the power, the right, and the ammunition to file a counter suit for harassment. They all agree that he could file for his original $1,000,000.00 plus an extra $1,000,000.00 for all the crap and then the trustees will have to tell the township that they are being sued for $2,000,000.00 and the town has to help pay for it. Plus he can sue for all the court costs. Just me thinking and talking with my dad. |

Well, I think that as long as there are still pending actions regarding a pre-existing case, a counter-suit will draw out the battle. Larry finally got back the ability to have Halloween Knights again. If there's something else that can be done, and a counter-suit thrown on top of it, he might need to hold off on having it until all of *that* is settled as well....
Maybe that's a reason not to counter-sue, at the current time that is.

That, and suing government entities is something of a very sticky situation.
What with sovereign immunity and all.
Sure, it probably doesn't apply. But from what little I have read up on the subject online, you basically have to prove it doesn't apply first, as that is the first thing they throw up for a defense. So, it all sounds rather long, drawn-out, and costly.
Though I am sure he could possible file for some kind of injuction against them.
That might at least slow down the crap they throw his way.

A pox on politicians who make sport of the Great Lakes Medieval Faire.
Wherefore art they so knuckle-headed?
The Trumbull Township trustees have spent 13 years wasting taxpayer money and losing court cases in an effort to bludgeon the Medieval Faire into oblivion.
The six-weekend-long event -- which just concluded its 17th year of jousters, jesters and jugglers -- is a moneymaker. The director of the Ashtabula County Convention and Visitors Bureau describes it as a key portion of the county's $346 million annual tourism take.
Trustees Chairman Ron Tamburrino cites health and safety concerns, but Lt. Greg Leonhard says the Sheriff's Department gets more complaints about the county fair.
Embattled owner Larry Rickard hosts the Medieval Faire on his property -- nearly 180 acres transformed into the 13th-century Village of Avaloch. But the cost of fighting frivolous court actions has topped $1 million and is taking a toll on the faire's future.
It is the largest employer in the township and one of the largest in the county, hiring more than 500 people.
Hundreds of supporters showed up at a recent meeting to protest the three township trustees' logic-defying -- and costly -- feud with the faire. Just in the past year, Tamburrino told residents the township had spent about $60,000 on litigation.
The trustees would better serve their constituents by filling potholes rather than enriching lawyers -- especially now that Rickard has run afoul of a higher power: The state attorney general has accused him of misappropriating funds meant for charities. If something's rotten in Avaloch, the faire will be on shaky ground.

I am unsure of how Larry has misappropriating funds meant for charity. If they are referring to the money given to the fire department I'm really confused. Doesn't Larry have a right to choose who he gives money to if it's charitible? So if the trustees took away the ambulance service and then Larry stopped donating doesn't he have the right to do so? When I give to a charity I have the right to choose who I give to and how much. If for some reason I no longer wish to donate to that charity have I broken a law?
Are they claiming that Larry kept money from the APL or the Blood Mobile? I don't see how he did that.

It was a trustee's misdirect to take the spotlight off of their questionable doings and cast doubt on Larry. All the charaties contacted said they recieved the monies.

So somewhere along the lines they must have found something they did not agree with. (Probably due to the Trustees trying to find something.) This could be that Larry told one of his many charities that he would give them $5000 but only gave $2000. The Attorney General would want to see where the other $3000 went . (NOT SAYING HE DID THIS...THIS IS JUST AN EXAMPLE.) Yes, he can choose to give or not give, but, once you agree on an amount with a charity you have to follow through. Usually you make agreements every year, it is not really a continuing agreement. (AGAIN, I AM NOT SAYING HE DID NOT FOLLOW THROUGH, JUST EXPLAINING THINGS.) But, maybe the Trustees put a big enough bug in the Attorney General's ear for them to get involved. If Larry says all his many charities received all the money ear-marked for them then I believe Larry. His books would be able to prove it and the charities themselves can prove it. |
